What is an uncontested divorce?

An uncontested divorce is where both spouses agree that they wish to be divorced AND they agree on all issues regarding child custody, visitation, financial matters, division of marital assets/debts and spousal support. 

what is a "no-fault" divorce?   

"No-fault” is not a type of divorce, but rather a ground for divorce that does not assign blame to either party or require a prolonged waiting period. To obtain a divorce in New York based on the “no-fault” ground, the spouses must do two things: (1) one party must affirm that the marriage has irretrievably broken down for at least six months AND (2) the parties must have resolved all issues relating to children, finances, and assets/debts.  Submitting a negotiated separation agreement to the court will satisfy the second requirement.

Do i need a separation agreement?

A separation agreement is a legal contract between spouses that addresses the division of assets and debts, as well as support, maintenance, custody or visitation issues. A separation agreement is enforceable by the courts.  If you and your spouse have children or any significant assets and/or debt, it is advisable to have a separation agreement detailing the terms of your split. 

does my spouse have to sign the divorce papers?

Yes.  Your spouse will have to sign an Affidavit of Defendant saying that he or she agrees to the divorce.

will i need to go to court?
